Freedom of speech is superior to the law because speech preceded and made the law. Free speech regulates the government and laws. Information provided in speech, whether we disagree with the message content or style of delivery, is how people become informed on issues and learn about politicians they may want to elect the government. The political process demands a free flow of information. Therefore, the rights afforded to the press are outside the rights of the law, with the only restrictions being against libelous statements and lies intended to slander.
People are free to say what they want, with full knowledge that their listeners may choose to retaliate using legal and illegal means, though some legal avenues of redress shouldn't be.
